AN ACT AUTHORIZING THE CONVEYANCE OF EASEMENTS BY THE CITY OF FITCHBURG TO THE TOWN OF WESTMINSTER
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding any general or special law to the contrary, the city of Fitchburg may grant to the town of Westminster certain permanent roadway, drainage, utility and related easements and temporary construction easements, as such easements are described in section 3, in and to the parcels of land located in the town of Westminster described in section 2 for the Worcester road, state highway route 140, reconstruction project.
SECTION 2. The parcels of land owned by the city of Fitchburg in and to which easements are authorized to be conveyed pursuant to section 1 are identified as parcels 186-1 and 120-39 on the assessors’ maps for the town of Westminster and described in deeds recorded in the Worcester northern district registry of deeds in: book 55, page 318; book 211, page 439; book 259, page 317; book 334, page 601; book 363, page 115; book 376, page 425, or however the same may have been acquired. The parcels were originally acquired for water supply purposes and are currently vacant.
SECTION 3. The permanent roadway, drainage, utility and related easements authorized to be conveyed pursuant to section 1, containing 2,000 square feet, more or less, in the aggregate, and the temporary construction easements to be conveyed to the town of Westminster pursuant to said section 1, containing 13,000 square feet, more or less, in the aggregate, are approximately shown on plans entitled “Massachusetts Department of Transportation Highway Division Plan and Profile of Route 140 (Worcester Road)”, as may be amended, on file with the town clerk of the town of Westminster.
SECTION 4. In consideration for the grant of easements authorized to be conveyed by the city of Fitchburg to the town of Westminster pursuant to section 1, the town of Westminster shall convey to the city of Fitchburg, for water supply protection and passive recreation, the parcel of land located off Dawley road in the town of Westminster, currently held by the town for general municipal purposes, and identified as parcel 123-19 on the assessors’ maps in the town of Westminster, containing 27,878 square feet, and acquired by the town by instrument recorded in the Worcester northern district registry of deeds in book 9460, page 187.
SECTION 5. This act shall take effect upon its passage.
