AN ACT AUTHORIZING THE CITY OF CAMBRIDGE TO USE CERTAIN LAND FOR GENERAL MUNICIPAL PURPOSES AND THE INSTALLATION OF SUBSURFACE GEOTHERMAL WELLS.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. The city of Cambridge may use for general municipal purposes, including, but not limited to, school purposes and for all purposes incidental thereto, a portion of an area of land owned by the city at the Father Callanan playground and fields located at Concord avenue near Alpine street in the city of Cambridge currently used for park, playground or recreational purposes. The land is more particularly described in a document recorded with the Middlesex South registry of deeds in book 5077, page 265 and a portion of the land is shown as “Open Space Area (Article 97)” on a plan entitled “Open Space Article 97 Plan Tobin Montessori and Vassal Lane Upper School Cambridge, MA” prepared by Nitsch Engineering on May 5, 2021, which is on file with the city. The portion of the land that the city may use for general municipal purposes, including, but not limited to, school purposes and for all purposes incidental thereto, consists of 10,640 square feet, more or less, shown as “A97 Open Space to be Relocated” in grey on “Attachment B” to the March 29, 2021 letter from the city manager of the city of Cambridge to the city council, which is on file with the city.
SECTION 2. The city of Cambridge may use for installation and maintenance of subsurface geothermal wells a portion of the land described in a document recorded with the Middlesex South registry of deeds in book 5077, page 265 and shown as “Open Space Area (Article 97)” on a plan entitled “Open Space Article 97 Plan Tobin Montessori and Vassal Lane Upper School Cambridge, MA” prepared by Nitsch Engineering on May 5, 2021, which is on file with the city. The portion of the land that the city may use for the installation and maintenance of subsurface geothermal wells is shown as “Geothermal Wells (6’ Below Grade)” and shaded green on “Attachment C” to the March 29, 2021 letter from the city manager of the city of Cambridge to the city council, which is on file with the city. The surface above the geothermal wells shall be restored and continue to be used for park, playground or recreational purposes.
SECTION 3. As a condition of allowing the land described in section 1 to be used for general municipal purposes as set forth in said section 1, the city of Cambridge shall designate for park, playground or recreational purposes an area of land consisting of 14,800 square feet, more or less, currently utilized for general municipal purposes and shown in blue on “Attachment B” to the March 29, 2021 letter from the city manager of the city of Cambridge to the city council, which is on file with the city.
SECTION 4. This act shall take effect upon its acceptance by a majority vote of the city council of the city of Cambridge.
