AN ACT AUTHORIZING THE TOWN OF ASHBY TO GRANT CERTAIN EASEMENTS.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


SECTION 1. The town of Ashby, acting by and through its board of selectmen, may grant easements in a certain parcel of land located in the town, which was acquired for town common and cemetery purposes, for a public access driveway. The use of the easements may include the installation, maintenance and repair of the driveway, necessary walkways and related drainage, for the United States post office to be located on an adjacent parcel of land and for all other lawful uses, including, but not limited to, the granting of a permanent easement for the encroachment, if any, of buildings and structures existing on the adjacent parcel, including, but not limited to, the existing stairs and walkway to the common road, the extension of an existing porch around the north side of an existing building, the construction of stairs from the south side of the porch to the public sidewalk on state route 119, and such temporary easements as may be necessary to make any repairs to the buildings or structures to accommodate the post office. No such easements shall disturb or affect the public's right of access to the portions of the parcel of town land now being used and maintained as a town common or burial grounds.

SECTION 2. This act shall take effect upon its passage.
