AN ACT AUTHORIZING THE CITY OF LOWELL TO GRANT A PERMANENT EASEMENT IN CERTAIN PARK LAND TO ABUTTERS.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


SECTION 1. The city of Lowell may grant and convey to the abutting owners of 474 Beacon street in the city a permanent easement in certain park and playground land located in the city, which shall be used for driveway and other open uses by these abutters, and no structures shall be built on the land. The land is shown on a plan of land entitled "Site Plan of Land in Lowell, Mass. owned by Mark and Cheryl Fisher 474 Beacon Street, Lowell, assachusetts 01850 showing existing conditions and proposed easement area" prepared by Desmarais Associates, Inc., registered professional land surveyors dated March 27, 1999.

SECTION 2. No deed conveying the easement described in section 1 shall be valid unless the deed provides that the easement property shall be used solely for the purposes described in said section 1 and that, if the easement property ceases to be so used, the easement shall revert to the city of Lowell for park or playground purposes.
