AN ACT AUTHORIZING A PUBLIC WATERFRONT WALKWAY TO BE EXEMPTED FROM THE HARBOR LINE IN THE CHARLESTOWN NAVY YARD IN THE CITY OF BOSTON.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


SECTION 1. Notwithstanding sections 14 and 34 of chapter 91 of the General Laws or any other general or special law to the contrary, the department of environmental protection may amend existing license no. 8529 granted to Joinery Shop Associates, its successors and assigns, to permit, on such conditions as the department shall determine, installation, maintenance, repair, and replacement of a public waterfront walkway on piles beyond the harbor line in the vicinity of and adjacent to building no. 114 and the abandoned abutment of the old Chelsea Street Bridge in the Charlestown section of the city of Boston, provided that the piles beyond the harbor line for the walkway shall not be installed beyond the mean low water line. Nothing in this act shall exempt the walkway from substantive and procedural requirements of said chapter 91 and regulations promulgated thereunder, other than the exception permitted in this section from the harbor line requirements of said sections 14 and 34 of said chapter 91.

SECTION 2. A plan showing the specific location of the walkway and the mean low water line shall be incorporated in the amendment to said license no. 8529 and made available for public inspection.
