AN ACT ESTABLISHING THE POSITION OF TOWN CLERK IN THE TOWN OF CHARLEMONT.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:

SECTION 1. Notwithstanding any general or special law, rule or regulation to the contrary, there shall be established in the town of Charlemont the office of town clerk, and the town clerk shall be appointed by a majority vote of the board of selectmen for a term to be determined by said board. The board of selectmen shall set the compensation of the town clerk, not to exceed the amount appropriated by the town meeting, and shall establish the duties of the town clerk. The board of selectmen may remove the town clerk by the majority vote of the entire board. If any provision of this act conflicts with a provision of a special act, by-law or rule or regulation of the town, the provisions of this act shall govern.

SECTION 2. Notwithstanding section 1, the incumbent in the office of town clerk upon the effective date of this act shall continue to hold that office and perform the duties thereof until the expiration of the term for which he was elected and the appointment and qualification of a successor, or until the incumbent otherwise vacates the office.
