AN ACT FURTHER REGULATING CERTAIN LICENSES FOR THE SALE OF ALCOHOLIC BEVERAGES.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:

SECTION 1. Section 15 of chapter 138 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by striking out, in line 23, the word “three” and inserting in place thereof the following figure:- 5.

SECTION 2. Said section 15 of said chapter 138 is hereby further amended by striking out the figure “5”, inserted by section 1, and inserting in place thereof the following figure:- 7.

SECTION 3. Said section 15 of said chapter 138 is hereby further amended by striking out the figure “7”, inserted by section 2, and inserting in place thereof the following figure:- 9.

SECTION 4. Said section 15 of said chapter 138, as appearing in the 2010 Official Edition, is hereby further amended by striking out, in line 28, the figure “3” and inserting in place thereof the following figure:- 5.

SECTION 5. Said section 15 of said chapter 138 is hereby further amended by striking out the figure “5”, inserted by section 4, and inserting in place thereof the following figure:- 7.

SECTION 6. Said section 15 of said chapter 138 is hereby further amended by striking out the figure “7”, inserted by section 5, and inserting in place thereof the following figure:- 9.

SECTION 7. The first paragraph of said section 15 of said chapter 138, as appearing in the 2010 Official Edition, is hereby further amended by inserting after the second sentence the following 2 sentences:- Each applicant for a new license or the transfer of a license shall pay a fee of up to $5,000 to the commission when the issuing of the new or transferred license would result in the applicant owning more than 3 licenses. The fee shall be paid to the commission after approval of the application but before the issuance of the new or transferred license.

SECTION 8. Sections 1 and 4 shall take effect on January 1, 2012.

SECTION 9. Sections 2 and 5 shall take effect on January 1, 2016.

SECTION 10. Sections 3 and 6 shall take effect on January 1, 2020.
