AN ACT REGULATING THE GRANT OF SEWER SYSTEM CONNECTIONS BY THE BOARD OF SEWER COMMISSIONERS OF THE TOWN OF KINGSTON.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:

SECTION 1. Chapter 250 of the acts of 2006 is hereby amended by inserting after section 1 the following 3 sections:-
Section 1A. The board of sewer commissioners shall have the sole authority to establish a program by which the board may purchase sewer capacity that has been previously allocated to a vacant parcel and for which a betterment has been assessed but has not been utilized. The board shall have the sole authority to reallocate any capacity purchased through an established capacity purchase program under the standard methods for allocation.
Section 1B. The board of sewer commissioners may establish a fund for the deposit of money received for the purchase of sewer capacity under the sewer capacity purchase program. The board may expend money from that fund, or from any other legal funding sources, for the purchase of sewer capacity under the sewer capacity purchase program without further appropriation.
Section 1C. At such time as the board of sewer commissioners establishes a sewer capacity purchase program, it shall adopt rules and regulations for the effective administration of the program.

SECTION 2. Sections 1A and 1B of chapter 250 of the acts of 2006 shall take effect upon passage of this act.
