AN ACT RELATIVE TO SHELLFISH AQUACULTURE LICENSE FEES IN THE TOWN OF MATTAPOISETT.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:

Notwithstanding section 64 of chapter 130 of the General Laws, the town of Mattapoisett, acting by and through its board of selectmen, may charge a fee of not more than $200 per acre for shellfish aquaculture licenses granted pursuant to section 57 of said chapter 130. The fee for each license shall be equal to the cost to the town of overseeing, supervising, inspecting and taking appropriate measures to enforce compliance with the terms and conditions of the license. The town may require that the licensees post a bond in an amount determined by the board of selectmen to be sufficient to pay for the costs of any remedial measures required by the town as necessary should the licensee fail to remedy any deficiency. Upon learning of a defect, the town shall send a written notice to the licensee, informing the licensee of the defect and providing the license with a reasonable opportunity to cure the defect. In the event that the licensee abandons the licensed operation and it becomes a danger to navigation, public safety or health, the town shall cure the defect.
