AN ACT AUTHORIZING THE TOWN OF HINGHAM TO CHANGE THE USE OF CERTAIN PARCELS OF LAND IN THE TOWN.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:

SECTION 1. The town of Hingham, acting by and through its board of selectmen, may change the use of a certain parcel of land acquired by the town for park and recreation purposes to a use by the town for general municipal purposes. The parcel is located off Fort Hill street and contains approximately 3.21 acres, being a portion of a parcel acquired by the town of Hingham from the United States Department of the Interior by deed dated May 12, 1972. A corrective deed to the town dated June 27, 1973 was recorded in the Plymouth county registry of deeds in book 3917, page 327. The land to be transferred is a portion of lot 1 on assessors’ map 77 and is also shown as “Parcel 2” on a plan entitled “Open Space Modification Plan, Bare Cove Park Drive, Hingham, MA 02043” prepared for the town of Hingham by Coler & Colantonio, Inc., dated March 8, 2012.

SECTION 2. In consideration for the change of use authorized in section 1, the town of Hingham shall dedicate a parcel of land for park and recreation purposes that is currently held for general municipal use. The parcel, containing approximately 10.08 acres, is a portion of a parcel acquired by the town from the United States Department of Health, Education and Welfare by deed dated December 17, 1973, recorded in the Plymouth county registry of deeds in book 3961, page 701, and described in the deed as “School Tract IV”. The parcel is a portion of lot 44 on assessors’ map 69 and is also shown as “Parcel 1” on the plan referenced in said section 1. The board of selectmen of the town of Hingham may grant restrictions on the parcel as it deems necessary and appropriate.

SECTION 3. The parcels of land described in sections 1 and 2 shall be subject to certain restrictions and covenants as set forth in the deeds from the United States Department of the Interior and the United States Department of Health, Education and Welfare to the town of Hingham. The changes of use of the parcels under this act shall require the advance written approval by the United States Department of the Interior or its designee.

SECTION 4. The town of Hingham shall execute, acknowledge and deliver to the United States Department of the Interior, or its successor or designee, any deeds, instruments or other documents as may be necessary to implement this act.

SECTION 5. This act shall take effect upon its passage.
