AN ACT AUTHORIZING THE TOWN OF NORWOOD TO MAKE CERTAIN CHANGES IN USE OF CERTAIN LAND FOR THE CONSTRUCTION AND OPERATION OF A REGIONAL INDOOR ICE SKATING RINK AND RECREATION CENTER.

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to provide for the construction and operation of a regional indoor ice skating rink and recreation center in the town of Norwood, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:

SECTION 1. (a) Notwithstanding any general or special law to the contrary, the town of Norwood, acting by and through its board of selectmen, may change the use of a parcel of land currently under the care, custody and management of the recreation department from outdoor recreational use to indoor recreational use for the construction and operation of a regional indoor ice skating rink and recreation center. The parcel is listed as parcel 8-1B-1A and contains approximately 30,520 square feet in a plan entitled “Land to be Transferred from Norwood School Department to Norwood Recreation Department” prepared by Mark P. Ryan, town engineer, dated April 30, 2013 and on file at the town of Norwood engineering department. The parcel shall remain under the care, custody and management of the recreation department.

(b) The town of Norwood, acting by and through its board of selectmen, may change the use of a parcel currently under the care, custody and management of the school department to the recreation department to be used for indoor recreational purposes. The parcel is listed as parcel 1 and contains approximately 121,210 square feet in the above referenced plan.

SECTION 2. Notwithstanding any general or special law to the contrary, as a condition of the change of use authorized in subsection (a) of section 1, the town of Norwood shall transfer a parcel currently under the care, custody and management of the school department to the recreation department and dedicate such land to outdoor recreational use. The parcel is listed as parcel 2 and contains approximately 43,750 square feet in the plan described above or other appropriate replacement land, subject to the approval of the executive office of energy and environmental affairs.

SECTION 3. The indoor ice skating rink and recreation center authorized in section 1 shall be a regional facility for, at a minimum, Eastern Massachusetts, which shall be open to the general public and shall not be limited to the residents of the town of Norwood.
