AN ACT RELATIVE TO THE FALMOUTH HISTORIC DISTRICT COMMISSION

     Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:
     SECTION 1.  Section 7 of chapter 654 of the acts of 1975 is hereby amended by striking out, in line 8, the following words “such public hearings as it deems advisable.” and inserting in place thereof the following words:-  a hearing on all applications.  The commission shall give public notice of the time, place and purpose of the hearing by posting notice with the town clerk at least 7 days in advance of the hearing.  Notice shall also be sent by regular mail to property owners, who are within the historic district, and are within 100 feet of any part of the land of the applicant.
     SECTION 2.  Section 8 of said chapter 654 is hereby amended by adding the following paragraph:-
     (i)  No application, which has been denied by the commission in the past 12 months, shall be approved unless the commission finds, by a 4/5 vote, specific and material changes in the condition, which was the basis for the previous denial.  Public notice shall be given of the time and place of the meeting when the matter will be considered and the vote will be taken.
