AN ACT AUTHORIZING THE CONVEYANCE OR LEASE OF A PARCEL OF LAND IN THE CITY OF NORTHAMPTON FOR PARK, RECREATION OR OPEN SPACE PURPOSES.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:

Notwithstanding any general or special law to the contrary, the commissioner of capital asset management and maintenance may sell, lease for a term of up to 99 years, including all renewals and extensions, or otherwise grant, convey or transfer to the city of Northampton for nominal consideration a certain parcel of land located between the intersection of King street and Merrick lane and the probate court sidewalk, containing approximately 0.014 acres, together with any buildings and structures thereon for use by the Northampton Rotary Club to be used only for the construction of a public park or other recreation or open space purposes. The Northampton Rotary Club shall: (i) be responsible for all costs and expenses including, but not limited to, costs associated with engineering, surveys, appraisals and deed preparation, related to the conveyance, lease or transfer authorized by this act as such costs may be determined by the commissioner of capital asset management and maintenance; and (ii) work with the city to ensure future maintenance of the property. If at any time the property ceases to be used for the purposes described in this section, ownership and control of the parcel shall revert to the division of capital asset management and maintenance.
