AN ACT AUTHORIZING THE COMMISSIONER OF CAPITAL ASSET MANAGEMENT AND MAINTENANCE TO CONVEY AN EASEMENT OVER A CERTAIN PARCEL OF LAND IN THE TOWN OF DRACUT

     Whereas, The deferred operation of this act would tend to defeat its purpose, which is to authorize forthwith the conveyance of a certain easement, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.

     Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:
     SECTION 1.  Notwithstanding sections 32 to 37, inclusive, of chapter 7C of the General Laws or any other general or special law to the contrary, the commissioner of capital asset management and maintenance, in consultation with the commissioner of conservation and recreation may grant to the Dracut Water Supply District, for consideration as provided in section 2, an easement to construct and maintain a new water tower or standpipe together with all rights necessary and incidental thereto, on a certain parcel of land identified as Parcel 5 in a deed recorded with the Middlesex north district registry of deeds in book 876, page 228, being a portion of the Lowell-Dracut-Tyngsborough State Forest.  The exact location of the water tower or standpipe and pipes, pumps, connections, appurtenances and rights of way on the Parcel 5 shall be determined by the board of water commissioners of the Dracut Water Supply District at the time of construction.
     SECTION 2.  In consideration for and as a condition of the conveyance of the easement authorized in section 1, the Dracut Water Supply District shall release the easement granted to the district in a deed recorded with the Middlesex north district registry of deeds in book 872, page 85, on a certain parcel of land identified as Parcel 4 in a deed recorded with the Middlesex north district registry of deeds in book 876, page 228.
