AN ACT AUTHORIZING THE CITY OF NEW BEDFORD TO GRANT AN ADDITIONAL LICENSE FOR THE SALE OF ALL ALCOHOLIC BEVERAGES NOT TO BE DRUNK ON THE PREMISES.

     Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:
     SECTION 1.  (a) Notwithstanding section 17 of chapter 138 of the General Laws, the licensing authority of the city of New Bedford may grant 1 additional license for the sale of all alcoholic beverages not to be drunk on the premises pursuant to section 15 of said chapter 138 to Cuve Wine LLC d/b/a Crush New Bedford, located at 801 Purchase street. The license shall be subject to all of said chapter 138 except said section 17.
     (b)  Upon the issuance of the license authorized by this act, Cuve Wine LLC d/b/a Crush New Bedford shall surrender to the licensing authority the license it currently holds for the sale of wines and malt beverages not to be drunk on the premises.
     (c)  Once issued, the licensing authority shall not approve the transfer of the license granted pursuant to this act to any other person, partnership, corporation, limited liability company, organization or entity. The licensee shall obtain approval from the licensing authority in order to transfer the license to a new location, which may only be in the area between Elm street and Walnut street that is between County street and state highway route 18 in the city of New Bedford.
     (d)  If the license granted pursuant to this act is cancelled, revoked or no longer in use, the license shall be returned physically, with all legal rights, privileges and restrictions pertaining thereto, to the licensing authority and the licensing authority may then grant the license to a new applicant at the same location and under the same conditions as specified in this act.
     SECTION 2.  This act shall take effect upon its passage.
