AN ACT AUTHORIZING THE TOWN OF MOUNT WASHINGTON TO ESTABLISH, OWN AND OPERATE BROADBAND INFRASTRUCTURE AND SERVICES AND TO ISSUE BONDS OR NOTES THEREFOR

     Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:
     SECTION 1.  (a) Notwithstanding any general or special law to the contrary, the town of Mount Washington may own, operate, maintain or manage broadband high speed internet infrastructure and services or hire others to do so on its behalf and may take any reasonable action necessary to establish and operate broadband high speed internet infrastructure and services without establishing a municipal lighting plant. 
     (b)  Notwithstanding clauses (8) and (8A) of the first paragraph of section 8 of chapter 44 of the General Laws, the town of Mount Washington may borrow from time to time such sums as necessary for the purposes of this act. The town may issue bonds or notes for such debt for a term not to exceed 20 years, exclusive of the term of any temporary loan issued in anticipation thereof, and shall otherwise be subject to said chapter 44.
     SECTION 2.  This act shall take effect upon its passage.
