AN ACT AUTHORIZING THE CITY OF NORTHAMPTON TO RELEASE A CERTAIN CONSERVATION EASEMENT AND CONSERVATION RESTRICTION.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:

SECTION 1. Notwithstanding any general or special law to the contrary, the city of Northampton, acting by and through its conservation commission, may release all rights to a 12,700, more or less, square foot right-of-way easement and conservation restriction shown as “20’ wide conservation easement in favor of city of Northampton (Section 2)” on a survey plan of land recorded at the Hampshire registry of deeds in plan book 238, page 102, which was granted to the city by deed recorded at the Hampshire registry of deeds in book 8983, page 250.

SECTION 2. As a condition and in consideration for the release of the easement and conservation restriction authorized in section 1 and at the same time of such release, the city of Northampton, acting by and through its conservation commission, shall acquire, for conservation purposes, a 19,789, more or less, square feet right-of-way easement and conservation restriction shown as “Proposed 20’ wide conservation easement to be granted to the city of Northampton” on the survey plan recorded at the Hampshire registry of deeds in plan book 238, page 102.
