AN ACT AUTHORIZING THE DEPARTMENT OF FISH AND GAME TO ACQUIRE A CONSERVATION RESTRICTION ON CERTAIN PARCELS OF LAND OF THE TOWN OF GROVELAND.
Whereas, The deferred operation of this act would tend to defeat its purpose, which is to authorize forthwith the department of fish and game to acquire a conservation restriction on land of the town of Groveland, therefore, it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:
SECTION 1. Notwithstanding any general or special law to the contrary, the commonwealth, by and through the department of fish and game, may take, under chapter 79 of the General Laws, or otherwise acquire, and the town of Groveland may convey, for no consideration, a conservation restriction on certain parcels of land identified in section 2 for the preservation and protection of wildlife habitat, passive recreation and consistent purposes.
SECTION 2. The parcels of land on which a conservation restriction may be granted are as follows:
(i) land on Uptack road, identified by the Groveland assessors as map 52-31-0, described in a deed to the town recorded in the Essex southern district registry of deeds in book 5902, page 40;
(ii) land on Uptack road, identified by the Groveland assessors as map 53-2-A, described in a deed to the town recorded in the Essex southern district registry of deeds in book 27227, page 69; and
(iii) land on Stephenson’s way, identified by the Groveland assessors as map 47-53-A, described in a deed to the town recorded in the Essex southern district registry of deeds in book 28802, page 182.
SECTION 3. Costs and expenses associated with the transactions authorized in this act shall be apportioned as agreed by the town of Groveland and the department of fish and game.
