AN ACT RELATIVE TO A WAREHAM REDEVELOPMENT AUTHORITY.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:

SECTION 1. Chapter 270 of the acts of 1977 is hereby repealed. 

SECTION 2. Chapter 383 of the acts of 2004 is hereby repealed. 

SECTION 3. (a) Notwithstanding any general or special law to the contrary, there shall be a redevelopment authority in the town of Wareham. The redevelopment authority shall be a public body politic and corporate that shall have the powers and authority of a redevelopment authority under chapter 121B of the General Laws.

(b) Notwithstanding chapter 121B of the General Laws, the redevelopment authority of the town of Wareham shall be managed, controlled and governed by a board that shall consist of: (i) 2 members of the board of selectmen of the town, who shall be chosen by the board and who shall each serve for a 1-year term; (ii) the town administrator or a designee, who shall serve for the duration of the town administrator’s employment; (iii) the director of planning and community development, who shall serve for the duration of the director’s employment; and (iv) 1 registered voter of the town, who shall be selected by the board of selectmen and who shall serve a 3-year term. Three members shall constitute a quorum.

(c) The clerk of the town of Wareham shall administer the oath of office to the board members of the redevelopment authority of the town upon the appointment of a quorum of the members. Immediately following the administration of the oath, the town clerk shall issue a certification of the oaths to the state secretary. Upon receipt of the certification, the state secretary shall issue a certificate of organization to the authority.

SECTION 4. The redevelopment authority of the town of Wareham shall assume the assets and liabilities of the Community and Economic Development Authority established by chapter 270 of the acts of 1977. 

SECTION 5. Sections 1, 2 and 4 shall take effect upon the state secretary’s issuance of the certification of organization under subsection (c) of section 3. 

SECTION 6. This act shall take effect upon its passage.
