AN ACT RELATIVE TO AN AGRICULTURAL DEED RESTRICTION IN THE TOWN OF WESTBOROUGH.

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to authorize forthwith the conveyance of a portion of a certain parcel of land in the town of Westborough, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  Subsection (a) of section 2 of chapter 195 of the acts of 2018 is hereby amended by inserting after the figure “230” the following words:- on all or a portion of the premises described in said deed.

SECTION 2.  Subsection (b) of said section 2 of said chapter 195 is hereby amended by striking out the first sentence and inserting in place thereof the following sentence:- The consideration to be paid for the release authorized in subsection (a) shall be the difference between the fair market unrestricted value of the property, or the portion thereof being released from the restriction and reverter if less than the entire parcel, or the value of the proposed use, whichever is greater, and the agricultural fair value as determined by an independent appraisal commissioned by the commissioner.
