AN ACT AUTHORIZING THE COMMISSIONER OF THE DIVISION OF CAPITAL ASSET MANAGEMENT AND MAINTENANCE TO CONVEY AND ACQUIRE CERTAIN PARCELS OF LAND IN THE TOWN OF HALIFAX.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  Chapter 202 of the acts of 1998 is hereby repealed.

SECTION 2.  Notwithstanding sections 32 to 37, inclusive, of chapter 7C of the General Laws or any other general or special law to the contrary, the commissioner of capital asset management and maintenance, in consultation with the commissioner of fish and game, may convey by deed to the town of Halifax a parcel of land on Aldana road containing 39,120 square feet, more or less, which is a portion of the land more particularly described in a deed recorded with the Plymouth county registry of deeds in book 3980 and page 439, and shown on a plan recorded with the Plymouth county registry of deeds in plan book 43, page 56. Said parcel was acquired for fish and wildlife conservation purposes.

SECTION 3.  In consideration for the conveyance authorized in section 1, the town of Halifax shall convey to the commonwealth, acting by and through the commissioner of capital asset management and maintenance for the department of fish and game, for nominal consideration, a parcel of land located off Aldana road, which is a portion of the land more particularly described in a deed recorded with the Plymouth county registry of deeds in book  5057 and page 364 and shown as parcel B  on a plan recorded with the Plymouth county registry of deeds in plan book 35, page 240.

SECTION 4.  Notwithstanding any general or special law to the contrary, the town of Halifax shall be responsible for all costs and expenses of the transactions authorized in this act as determined by the commissioner of capital asset management and maintenance including, but not limited to, the costs of any engineering, surveys, title examinations, recording fees and deed preparation related to the conveyance of the parcels identified in sections 1 and 2 and all costs from liabilities and expenses of any nature and kind for its ownership.

SECTION 5.  The deed or other instrument conveying the parcel identified in section 1 to the town of Halifax shall provide that if the parcel ceases at any time to be used for the purposes of improvements to Aldana road, the title to the parcel shall, at the election of the commonwealth, revert to the commonwealth.
