AN ACT RELATIVE TO ELIGIBILITY FOR EMERGENCY ASSISTANCE TO ELDERLY, DISABLED RESIDENTS AND CHILDREN

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to establish forthwith new eligibility requirements for emergency assistance to elderly, disabled residents and children, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  Section 3 of chapter 117A of the General Laws, as appearing in the 2018 Official Edition, is hereby amended by inserting after the first paragraph the following paragraph:-

A person shall not be denied assistance under this chapter based wholly or in part on the amount of the person’s assets; provided, however, that any income generated by such assets may be treated as countable income.

SECTION 2.  This act shall take effect as of July 1, 2021.

This Bill having been returned by His Excellency the Governor with his objections thereto in writing (see House 4052) has been passed by the  House of Representatives, notwithstanding  said objections, two-thirds of the House (130 yeas to 29 nays) having agreed to pass the same.
