AN ACT AUTHORIZING THE TOWN OF HANSON TO AMEND A CERTAIN CONSERVATION RESTRICTION IN THE TOWN OF HANSON

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  The conservation commission and the board of selectmen of the town of Hanson may amend the conservation restriction imposed pursuant to the fourth paragraph of the order of taking dated February 25, 1975 and recorded in the Plymouth county registry of deeds in book 4050, page 355 as may be applied to a portion of the parcel, being 8.5 acres of the 62-acre parcel, and being more particularly described on the plan recorded in the Plymouth county registry of deeds in plan book 66, page 46 by adding the following language:

“; Provided, however, that 8.5 acres of said parcel as more fully described on the plan recorded in the Plymouth county registry of deeds in plan book 66, page 46 shall be used as conservation land and well head area purposes.”

SECTION 2.  The conservation commission and the board of selectmen of the town of Hanson or their designees of the town of Hanson shall take all actions as they deem necessary or advisable in their sole discretion to carry out the amendment of the conservation restriction and acceptance of a revised conservation restriction as set forth in this act including, but not limited to, the execution of all documents relative thereto.

SECTION 3.  As consideration for the amendment to the conservation restriction authorized in section 1, the town of Hanson shall, pursuant to section 3 of chapter 40 of the General Laws, transfer the care, custody and control of a certain 25.403 acre parcel identified on Assessors’ map 49 as Parcel 1-1A and a 21,780 SF parcel identified on assessors’ map 105 as parcel 6 from the board of selectmen to the conservation commission for the purpose of wildlife, recreation and forestry.
