AN ACT AUTHORIZING THE TOWN OF WAREHAM TO GRANT AN ADDITIONAL LICENSE FOR THE SALE OF MALT BEVERAGES NOT TO BE DRUNK ON THE PREMISES.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  (a) Notwithstanding section 17 of chapter 138 of the General Laws, chapter 236 of the acts of 2018, as amended by chapter 414 of the acts of 2018, or section 12 of said chapter 138 to the contrary, the licensing authority of the town of Wareham may grant an additional license for the sale of malt beverages containing malts produced on premises not to be drunk on the premises  pursuant to section 15 of said chapter 138 to Stone Path Malt, LLC located at 11 Kendrick road in the town of Wareham. The license shall be subject to all the requirements of said chapter 138, except section 17.

(b)  The licensee shall comply with such requirements and conditions as the local licensing authority shall deem appropriate, including, but not limited to, reporting on the brands of malt beverages sold pursuant to any license held by said licensee with a frequency as required by the local licensing authority. Failure to comply with such requirements and conditions shall result in revocation of the license granted under this act.

(c)  The licensing authority shall not approve the transfer of the license granted under this act to any other person, organization, corporation or location.

(d)  The license granted under this act shall be issued within 1 year after the effective date of this act.

SECTION 2.  This act shall take effect upon its passage.
