AN ACT AUTHORIZING THE TOWN OF DUDLEY TO GRANT ADDITIONAL LICENSES FOR THE SALE OF ALL ALCOHOLIC BEVERAGES NOT TO BE DRUNK ON THE PREMISES

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the local licensing authority of the town of Dudley may grant an additional license for the sale of all alcoholic beverages not to be drunk on the premises pursuant to section 15 of said chapter 138 to Om Shiv Corporation doing business as Patriot Gas, located at 251 West Main street in the town of Dudley. The license shall be subject to all of said chapter 138, except said section 17.
          (b) The licensing authority shall not approve the transfer of a license granted under this section to any other location, but it may grant a license to a new applicant at the same location if the applicant files with the licensing authority a letter from the department of revenue and a letter from the department of unemployment assistance indicating that the license is in good standing with those departments and that all applicable taxes, fees and contributions have been paid.
          (c) If a licensee terminates or fails to renew a license granted under this section or any such license is cancelled, revoked or no longer in use, it shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority which may, within 1 year after such return, then grant the license to a new applicant at the same location under the same conditions as specified in this section, otherwise such license shall dissolve.
          (d) All licenses granted pursuant to this section shall be issued not later than 1 year after the effective date of this act; provided, however, that a license originally granted within that time period may be granted to a new applicant pursuant to subsection (b) or (c) thereafter.

SECTION 2. Upon the issuance of the license pursuant to section 1 to Om Shiv Corporation doing business as Patriot Gas, located at 251 West Main street in the town of Dudley, the licensee shall return physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority, the license it currently holds for the sale of wines and malt beverages not to be drunk on the premises pursuant to section 15 of chapter 138 of the General Laws.

SECTION 3. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the local licensing authority of the town of Dudley may grant an additional license for the sale of all alcoholic beverages not to be drunk on the premises pursuant to section 15 of said chapter 138 to an establishment located within the UCH-TIF District in the town of Dudley as that district is defined by Appendix C of the Webster-Dudley French River Urban Center Housing TIF Plan as it existed as of January 25, 2022, upon approval of and under the conditions set by the licensing authority of the town of Dudley, a copy of which is on file in the office of the town clerk of the town of Dudley. The license granted pursuant to this section shall be clearly marked on its face “UCH-TIF District” and shall be subject to all of said chapter 138 except said section 17.
          (b) The licensing authority of the town of Dudley shall not approve the transfer of the license granted pursuant to this section to a location outside of the UCH-TIF District in the town of Dudley but it may grant the license to a new applicant within the UCH-TIF District in the town of Dudley if the applicant files with the local licensing authority a letter from the department of revenue and a letter from the department of unemployment assistance indicating that the license is in good standing with those departments and that all applicable taxes, fees and contributions have been paid.
          (c) The license granted pursuant to this act shall not be sold or transferred by the licensee. If a licensee terminates or fails to renew a license granted to an establishment located within the UCH-TIF District in the town of Dudley pursuant to this section or if any such license is cancelled, revoked or no longer in use, it shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority and the licensing authority may then grant the license to a new applicant in the UCH-TIF District in the town of Dudley under the same conditions as specified in this section.
          (d) The license granted pursuant to this section shall be issued within 3 years after the effective date of this act; provided, however, that a license originally granted within that time period may be granted to a new applicant pursuant to subsection (b) or (c) thereafter.

SECTION 4. This act shall take effect upon its passage.
