AN ACT RELATIVE TO COMMERCIAL DRIVER'S LICENSES
Whereas, The deferred operation of this act would tend to defeat its purpose, which is to amend the lookback period for certain disqualifying offenses for commercial driver’s licenses, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 9 of chapter 90F of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by striking out, in line 21, the word “subsection” and inserting in place thereof the following word:- paragraph.
SECTION 2. Said section 9 of said chapter 90F, as so appearing, is hereby further amended by striking out, in line 96, the word “subsection” and inserting in place thereof the following word:- paragraph.
SECTION 3. Said section 9 of said chapter 90F, as so appearing, is hereby further amended by adding the following paragraph:-
(I) A person shall not be disqualified from operating a commercial motor vehicle under paragraphs (A) or (B) based upon convictions that occurred on or before September 30, 2005, unless: (i) the person has 3 or more convictions for operating under the influence under section 24 of chapter 90; or (ii) disqualification from operating a commercial motor vehicle is required under 49 C.F.R. 383.51 or any other federal statute or regulation.
SECTION 4. The registrar shall promulgate regulations pursuant to its authority under paragraph (C) of section 9 of chapter 90F of the General Laws not later than July 1, 2025.
