AN ACT AUTHORIZING THE TOWN OF TRURO TO LEASE CERTAIN LAND TO THE TOWN OF PROVINCETOWN.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:

SECTION 1. Notwithstanding any general or special law to the contrary, the town of Truro may transfer the care, custody, management and control of 3 certain parcels of land, described in section 2, from the Truro board of selectmen currently held for well field purposes to the board of selectmen to be held for the purpose of leasing the parcels to the town of Provincetown for a term of 99 years for well field purposes and may lease the parcels to the town of Provincetown.

SECTION 2. The parcels of land authorized for transfer and lease in section 1 are shown as parcels 1, 2 and 3, respectively, on a plan entitled “Plan of Land in Truro Made for the Town of Truro” by Slade Associates, Inc. dated October 21, 2003 and recorded with the Barnstable county registry of deeds in plan book 589, page 49. The first parcel is approximately 6 acres, shown on assessor’s map 40 as parcel 71, located off North Union Field road and acquired by the town of Truro pursuant to an order of taking dated January 22, 2008 and recorded with said deeds in book 22651, page 174. The second parcel is approximately 4.19 acres, shown on assessor’s map 40 as parcel 77, also located off North Union Field road and acquired by the town of Truro pursuant to an order of taking dated January 22, 2008 and recorded with said deeds in book 22651, page 183. The third parcel is approximately .65 acres, shown on assessor’s map 40 as parcel 73, also located off North Union Field road and acquired by the town of Truro pursuant to an order of taking dated July 29, 2008 and recorded with said deeds in book 23090, page 71.

SECTION 3. This act shall take effect upon its passage.
