AN ACT PROVIDING FOR THE USE OF A CERTAIN PARCEL OF LAND IN THE CITY OF WOBURN FOR RECREATIONAL PURPOSES.

     Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:
     SECTION 1. (a) Notwithstanding section 15A of chapter 40 of the General Laws or any other general or special law to the contrary, the land of the Daniel P. Hurld Elementary School and surrounding fields acquired by the city of Woburn on or about October 19,1955, by a deed recorded in the Middlesex south district registry of deeds in book 8611, page 355, and located at 75 Bedford road in the city of Woburn, shown on assessors’ map 41 as block 9, lot 16, containing 11.27 acres more or less and shown on a plan of land entitled “City of Woburn Land Taking School Building” which is recorded in the Middlesex south district registry of deeds as plan no. 1346 of 1954, currently used for educational purposes, shall continue to be under the care, custody and control of the city of Woburn school committee and shall be used for educational purposes only; provided, however, that when the new Wyman/Hurld elementary school shall be completed and all students receiving educational services at the Daniel P. Hurld Elementary School have been reassigned to alternative sites within the Woburn school district, the school committee shall vote to authorize the transfer of the care, custody and control of the land to the Woburn recreation commission.
     (b)  Upon transfer to the Woburn recreation commission, the land described in subsection (a) shall be used solely for active or passive recreational uses including, but not limited to, community gardens, trails, noncommercial youth and adult sports and park, playground or athletic field purposes; provided, however, that recreational use of the land shall not include horse or dog racing or the use of the land for a stadium, gymnasium or other similar structure; and provided further, that any restriction on the use of the land shall be recorded in the Middlesex south district registry of deeds.
     SECTION 2.  This act shall take effect upon its passage.
