AN ACT AUTHORIZING THE DIVISION OF CAPITAL ASSET MANAGEMENT AND MAINTENANCE TO CONVEY A CERTAIN PARCEL OF LAND IN THE TOWN OF FOXBOROUGH TO THE FOXBOROUGH HOUSING AUTHORITY

     Whereas, The deferred operation of this act would tend to defeat its purpose, which is to transfer forthwith a certain parcel of land in the town of Foxborough for affordable housing, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.

     Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:
     SECTION 1.  Chapter 200 of the acts of 2012 is hereby amended by striking out section 1 and inserting in place thereof the following section:-
     Section 1.  Notwithstanding sections 33 to 38, inclusive, of chapter 7C of the General Laws or any other general or special law to the contrary, the commissioner of capital asset management and maintenance may convey a certain parcel of state-owned land in the town of Foxborough to the Foxborough Housing Authority for nominal consideration for affordable housing purposes. The parcel contains approximately 16.02 acres and is located at the intersection of state highway route 140 and Walnut street adjacent to the southbound ramp of interstate highway route 95 and is shown on town of Foxborough assessors’ map 133 as lot 3604. The parcel shall be conveyed by deed without warranties or representations by the commonwealth.
     SECTION 2.  Sections 2 and 3 of said chapter 200 are hereby repealed.
     SECTION 3.  Said chapter 200 is hereby further amended by adding the following section:-
     Section 6.  (a) The use of the parcel described in section 1 shall be restricted to the development of affordable housing which shall be approved by the department of housing and community development. Notwithstanding the foregoing or any other general or special law to the contrary, the Foxborough Housing Authority may lease the parcel or portions thereof to any entities and may enter into agreements with those entities for the purpose of developing, constructing, operating and maintaining affordable housing on the parcel.
     (b)  Notwithstanding section 34 of chapter 121B of the General Laws or any other general or special law to the contrary, any funds received by the authority as consideration for a lease made pursuant to section 6 shall be retained by the Foxborough Housing Authority for use in accordance with said chapter 121B and any applicable regulations.
