AN ACT AUTHORIZING THE CITY OF CHICOPEE TO ESTABLISH A WATER AND SEWER DEPARTMENT.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Chapter 103 of the acts of 1877 is hereby repealed.
SECTION 2. Chapter 384 of the acts of 1892 is hereby repealed.
SECTION 3. Section 38 of chapter 239 of the acts of 1897, as amended by chapter 512 of the acts of 2008, is hereby further amended by striking out, in lines 11 and 12, the words “; a board of water commissioners, to consist of three persons”.
SECTION 4. Said section 38 of said chapter 239, as so amended, is hereby further amended by striking out, in line 27, the words “, and of the water commissioners”.
SECTION 5. Said chapter 239 is hereby further amended by striking out section 45.
SECTION 6. Notwithstanding any general or special law to the contrary, the city of Chicopee may establish a water department and a sewer department under the jurisdiction of the Chicopee department of public works and may establish a combined water and sewer commission by way of local ordinance.
SECTION 7. This act shall take effect upon its passage.
