AN ACT AUTHORIZING THE TOWN OF WINTHROP TO CONTINUE THE EMPLOYMENT OF FIRE CHIEF, PAUL E. FLANAGAN.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  Notwithstanding any general or special law to the contrary, Paul E. Flanagan, fire chief of the town of Winthrop, may continue to serve in that position until June 30, 2023, the date of his retirement or the date he is relieved of his duties by the town manager of the town of Winthrop, whichever occurs first; provided, however, that he is mentally and physically capable of performing the duties of his office. The town manager may, at the expense of the town, require that Paul E. Flanagan be examined by an impartial physician on or about his sixty-fifth birthday and each year thereafter on or about his birthday to determine such capability. No further deductions shall be made from regular compensation of Paul E. Flanagan pursuant to chapter 32 of the General Laws for service subsequent to his reaching the age of 65 and upon retirement Paul E. Flanagan shall receive a superannuation retirement allowance equal to that which he would have been entitled had he retired on that date. Paul E. Flanagan shall continue to be a member in service under section 1 of said chapter 32 for purposes of eligibility for benefits under sections 7, 9 and 100 of said chapter 32 during any period after his sixty-fifth birthday while serving as fire chief.

SECTION 2.  This act shall take effect upon its passage.
