AN ACT AUTHORIZING THE MASSACHUSETTS WATER RESOURCES AUTHORITY TO RELEASE EASEMENTS UPON CERTAIN REAL PROPERTY IN THE TOWN OF STONEHAM

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to provide forthwith for the release of certain real property easements, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.___________

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  (a) Notwithstanding any general or special law to the contrary, but subject to paragraph (d) of section 9 of chapter 372 of the acts of 1984, the Massachusetts Water Resources Authority may release or relocate 3 easements, each of which is described in subsection (b) and is located upon a certain parcel of land in the town of Stoneham owned or formerly owned by Langwood Commons LLC.

(b)  The 3 easements authorized to be released or relocated pursuant to subsection (a) are: (i) the portion of the easement shown as “Water Easement (WE-1)” on Lot L on sheet 1 of Plan No. 1364 of 2007 recorded in the Middlesex southern district registry of deeds on December 21, 2007; (ii) the portion of the easement shown as “AE-8” on Lot L on sheet 2 of said plan; and (iii) the portion of the easement shown as “Proposed 25’ Utility Easement” on Lot L on sheet 2 of said plan.

SECTION 2.  (a) In consideration for the release or relocation of the easements pursuant to section 1, Langwood Commons LLC, Alta Langwood, LLC or both shall: (i) release the easements described in subsection (b), each of which is located upon a certain parcel of land in the town of Stoneham owned by the Massachusetts Water Resources Authority; and (ii) reduce the square footage of the easement described in subsection (c), which is located upon a certain parcel of land in the town of Stoneham owned by the Massachusetts Water Resources Authority, from 80,000 square feet, more or less, to 53,256 square feet, more or less.

(b)  The easements to be released pursuant to clause (i) of subsection (a) are: (i) the portion of the easement shown as “Water Easement (WE-1)” on Lots M and N on sheet 1 of the plan referenced in section 1; (ii) the portion of the easement shown as “AE-8” on Lot M on sheet 2 of said plan; (iii) the portion of the easement shown as “Proposed 25’ Utility Easement” on Lot M on sheet 2 of said plan; and (iv) the portion of the easement shown as “DE-7” on Lot M on sheet 2 of said plan.

(c)  The easement to be reduced pursuant to clause (ii) of subsection (a) is more particularly shown as the “Proposed Easement Area” on a draft plan, on file with the Massachusetts Water Resources Authority, entitled “Easement Plan of Land Spot Pond Water Storage Facility Woodland Drive Stoneham, MA” prepared by Bryant Associates and dated August 14, 2018.
