AN ACT AUTHORIZING THE TOWN OF SWANSEA TO ENTER INTO A LEASE AGREEMENT FOR MEDEIROS FARM

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  Notwithstanding any general or special law to the contrary, the board of selectmen of the town of Swansea may lease, under such terms as it deems prudent, all or portions of a certain parcel of land shown as lot 17 on the town of Swansea assessors’ map 27, located at 1100 Bark street and consisting of 22, acres more or less, which parcel is currently held by the town of Swansea for passive recreation, active recreation, including ballfields, and agriculture. The lease shall be for the creation and long-term maintenance of the public, natural surface ballfields on the parcel and the use of the ballfields for organized sporting activities. Prior to entering the lease, the town of Swansea shall place a conservation restriction on the parcel pursuant to sections 31 to 33, inclusive, of chapter 184 of the General Laws.  The lease shall require that the parcel of land remains open to the public for use and enjoyment at such times and purposes as not inconsistent with the use and maintenance of the ballfields for organized sports.  The proceeds of any lease entered into under this section shall be returned to the community preservation fund of the town of Swansea pursuant to section 7 of chapter 44B of the General Laws; provided, however, that any costs incurred by the lessee for the improvement and maintenance of the ballfields shall not be considered proceeds of the town under the lease.

SECTION 2.  This act shall take effect upon its passage.
