AN ACT AUTHORIZING THE CONVEYANCE OF CERTAIN PARCELS OF REAL ESTATE BETWEEN THE DEPARTMENT OF CONSERVATION AND RECREATION AND THE TOWN OF HOLDEN

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to authorize forthwith the exchange of certain parcels of land between the commonwealth and the town of Holden, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  Notwithstanding chapter 30B of the General Laws or any other general or special law to the contrary, the town of Holden may convey the following 2 parcels of land currently used for water supply protection and passive recreation to the commonwealth to be held under the care, custody and control of the department of conservation and recreation for water supply protection and passive recreation: (i) a parcel located off of North street, described in an instrument of taking for tax purposes recorded in the Worcester registry of deeds in book 50116, page 300, shown on town assessors’ map 44 as parcel 3 and containing approximately 9.67 acres of land; and (ii) a parcel located off of Meadow Wood drive, described in an instrument of taking for tax purposes recorded in the Worcester registry of deeds in book 3275, page 149, shown on town assessors’ map 161 as parcel 3 and containing approximately 11.65 acres of land.

SECTION 2.  Notwithstanding sections 32 to 37, inclusive, of chapter 7C of the General Laws or any general or special law to the contrary, as consideration for the conveyance authorized in section 1, the commissioner of capital asset management and maintenance, in consultation with the commissioner of conservation and recreation, following the conveyance authorized in section 1, shall convey to the town of Holden the following 2 parcels of land located in the town of Holden under the care, custody and control of the department of conservation and recreation for conservation and passive recreation which shall be held by the town for purposes consistent with Article 97 of the Amendments to the Constitution of the commonwealth: (i) a parcel located off of Salisbury street, described in a deed recorded in the Worcester registry of deeds in book 2430, page 136, shown on town assessors’ map 198 as parcel 5 and containing approximately 9.75 acres; and (ii) a parcel of land located off of Salisbury street, shown on assessors’ map 186 as parcel 8 containing approximately 8.66 acres of land. The parcel described in clause (i) shall be conveyed subject to a watershed preservation restriction held by the department of conservation and recreation pursuant to sections 31 to 33, inclusive, of chapter 184 of the General Laws requiring the land to remain in a natural state.

SECTION 3.  The conveyance authorized in section 2 shall be contingent upon the town of Holden agreeing to assume the cost of any appraisals, surveys and other expenses as deemed necessary by the commissioner of capital asset management and maintenance for the transactions authorized in this act.
