AN ACT AUTHORIZING THE TOWN OF EASTHAM TO MAKE UTILITY IMPROVEMENTS ON PRIVATE ROADS IN THE TOWN.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  Notwithstanding section 6N of chapter 40 of the General Laws or any other general or special law to the contrary, the town of Eastham may make permanent utility repairs or improvements on private ways in the town, appropriate money and contract with public utility companies for such purposes and assess betterments for costs incurred by the town therefor in accordance with the procedures set forth in chapter 118 of the code of the town.

SECTION 2.  Notwithstanding any general or special law to the contrary, the town of Eastham may borrow such sums as may be necessary for the purposes in section 1; provided, however, that any debt incurred shall be subject to chapter 44 of the General Laws and shall not exceed 20 years.

SECTION 3.  Any appropriation or borrowing by the town for purposes under this act shall not be included for the purpose of computation of the levy or borrowing limits otherwise imposed upon the town by the General Laws.

SECTION 4.  This act shall take effect upon its passage.
