AN ACT AUTHORIZING THE TOWN OF MASHPEE TO LEASE CERTAIN TOWN LAND TO THE BOYS AND GIRLS CLUB OF CAPE COD, INC

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Notwithstanding any general or special law to the contrary, the town of Mashpee, acting by and through its select board, may lease to the Boys and Girls Club of Cape Cod, Inc. a parcel of town-owned land for a term of 99 years at a rent of $1 per year and upon such other terms and conditions as said board deems appropriate. The parcel is currently vacant and is a portion of land described in the Barnstable county registry of deeds in book 587, page 525 and shown on the town of Mashpee assessor’s map 67, parcel 1 and more particularly shown on a plan entitled “Proposed Boys and Girls Club Expansion”, dated September 8, 2008, approved by vote of the May 1, 2023 Mashpee annual town meeting, a copy of which is on file in the office of the town clerk. The Boys and Girls Club of Cape Cod, Inc. shall use said property, in conjunction with its existing adjacent facility, to provide educational, recreational and cultural services to persons under the age of 18 years, either individually or in cooperation with other organizations, for the benefit of persons under the age of 18 years.

SECTION 2. In the event the parcel described in section 1 ceases to be used at any time during the lease term for the purposes specified herein, said parcel shall immediately revert to the care and control of the town of Mashpee.

SECTION 3. This act shall take effect upon its passage.
