AN ACT AUTHORIZING THE TOWN OF EASTHAM TO CONVEY A CONSERVATION RESTRICTION ON A CERTAIN PARCEL OF LAND TO THE EASTHAM CONSERVATION FOUNDATION, INC

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. (a) Notwithstanding any general or special law to the contrary, the town of Eastham, acting by and through its board of selectmen, may convey to the Eastham Conservation Foundation, Inc., for no consideration, a perpetual conservation restriction pursuant to sections 31 to 33, inclusive, of chapter 184 of the General Laws for habitat and conservation purposes in a certain parcel of land identified in subsection (b) that is currently used for open space purposes, upon such terms and conditions as the board of selectmen shall determine to be appropriate.
          (b) The land is identified as: a parcel of land on Ocean view drive, shown as “Proposed Parcel for Conservation Restriction, Total Acreage = 21.3 Acres” on a plan entitled “District H- Conservation Restriction Boundary Plan, Eastham, MA,” prepared by Environmental Partners Group, dated May 2018, Sheet No. FIG-4, and which is a portion of the land shown on a plan of land entitled “Plan of Land in Eastham, Mass. Made for the Town of Eastham” dated December 1969, prepared by Nickerson & Berger, Engineers, recorded in the Barnstable county registry of deeds in “Tube 156,” and described in an order of taking for recreational purposes recorded in the Barnstable county registry of deeds in book 1489, page 923.

SECTION 2. This act shall take effect upon its passage.
