AN ACT AMENDING THE APPOINTMENT OF AND ELECTION RESTRICTIONS ON FINANCE COMMITTEE AND CAPITAL PLANNING MEMBERS IN THE TOWN OF NEWBURY

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Chapter 460 of the acts of 2008 is hereby amended by striking out section 5 and inserting in place thereof the following section:-
        Section 5. A member of the select board, the regional school committee or the finance committee, during the term for which the member was elected or appointed, shall be ineligible by election or appointment to hold any other town office. Any other person appointed by the select board or town administrator to a town office under this act or any general or special law shall be eligible during the term of said office for appointment to any other town office; provided, however, that the town accountant shall not be eligible to hold the position of town treasurer or town collector. The town administrator, subject to applicable General Laws, may assume the duties of an office which the town administrator is authorized to fill by appointment. This section shall not apply to members of the finance committee who may be appointed to serve on the capital planning committee but shall be ineligible by election or appointment to hold any other town office. At no time shall more than 2 members of the finance committee serve on the capital planning committee.

SECTION 2. Said chapter 460 is hereby further amended by inserting after section 20 the following section:-
          SECTION 20A. For the purposes of this act, the term “town office” shall mean any position elected by registered voters of the town of Newbury or appointed by the select board, town administrator or other town board or committee of the town whose jurisdiction extends to the town limits and is not part of any greater regional or county organization or office.

SECTION 3. This act shall take effect upon its passage.
