AN ACT CHANGING THE POSITION OF TREASURER IN THE CITY OF HOLYOKE FROM AN ELECTED TO AN APPOINTED POSITION
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 6 of chapter 438 of the acts of 1896, as appearing in section 5 of chapter 189 of the acts of 1992, is hereby amended by striking out, in line 2, the words “, city treasurer”.
SECTION 2. Section 15 of said chapter 438 is hereby amended by inserting after the third sentence, as appearing in section 14 of said chapter 189, the following 3 sentences:- The city council shall also in the month of January, beginning in calendar year 2026, elect by ballot a treasurer who shall hold the office for a term of 3 years beginning on the first Monday in February in the year of the election and continuing until a successor is elected and qualified unless the position is sooner vacated. The qualifications for the position of treasurer shall be established by ordinance. The treasurer in office in the city of Holyoke on the effective date of this act shall continue to hold office until the first Monday in February 2026.
SECTION 3. If any provision of chapter 438 of the acts of 1896 or chapter 327 of the acts of 1936 is inconsistent with this act, the provisions of this act shall control.
SECTION 4. The city of Holyoke may conduct a special municipal election on Tuesday, January 28, 2025 to vote on the question of acceptance of this act by the voters. Such charter change and the related provisions of this act shall take effect upon its approval by the voters.
SECTION 5. Section 4 of this act shall take effect upon its passage and sections 1 to 3, inclusive, shall take effect upon their acceptance by the voters of the city of Holyoke, but not otherwise.
