AN ACT AUTHORIZING THE TOWN OF ACUSHNET TO CONTINUE THE EMPLOYMENT OF CALL DEPUTY FIRE CHIEF DAVID MAKUCH
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding any general or special law to the contrary, David Makuch, the call deputy chief of the fire department of the town of Acushnet, may continue to serve in such position until the date upon which he reaches the age of 70, the date of his retirement or the date he is relieved of his duties by the board of selectmen of the town of Acushnet, whichever occurs first; provided, however, that he is mentally and physically capable of performing the duties of his office; provided further, that the board of selectmen may, at the town's own expense, require that David Makuch be examined annually by a physician designated by the town to determine such capability; provided further, that no further deductions shall be made from the regular compensation of David Makuch pursuant to chapter 32 of the General Laws for any service subsequent to his reaching the age of 65; and provided further, that, upon retirement, David Makuch shall receive a superannuation retirement allowance equal to that which he would have been entitled had he retired at the age of 65.
SECTION 2. This act shall take effect upon its passage.
