AN ACT EXEMPTING THE REDEVELOPMENT OF CERTAIN AFFORDABLE HOUSING IN THE TOWN OF WESTBOROUGH FROM PUBLIC PROCUREMENT LAWS

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. The Westborough Affordable Housing Trust Fund or any limited liability company, corporation or limited partnership owned, controlled or managed by the Westborough Affordable Housing Trust Fund or any successor in interest shall be exempt from any general or special law related to the procurement and award of contracts for the planning, design, construction management, construction, reconstruction, installation, demolition, maintenance or repair of public buildings by a public agency, including, but not limited to sections 44 to 58, inclusive, of chapter 7C of the General Laws, section 39M of chapter 30 of the General Laws and sections 44A to 44H, inclusive, of chapter 149 of the General Laws, with respect to: (i) 6 Beach street in the town of Westborough, shown on the Westborough assessors’ map as parcel 21-177-0; and (ii) 45 High street extension in the town of Westborough, shown on the Westborough assessors’ map as parcel 27-171-0 or any part thereof; provided, however, that the exemption authorized under this section shall not include any exemption from the payment of prevailing wages to the extent required pursuant to sections 26 to 27H, inclusive, of said chapter 149.

SECTION 2. A conveyance of the project, whether by leasehold or fee estate, to an urban redevelopment corporation organized pursuant to chapter 121A of the General Laws or to a nonprofit state and federally tax-exempt corporation organized for the purpose of, or to a limited partnership or limited liability company whose primary purpose is, revitalizing the project shall be subject to chapter 30B of the General Laws to the extent that the project is conveyed to an entity that is not owned, controlled or managed by the Westborough Affordable Housing Trust Fund or any successor.

SECTION 3. This act shall take effect upon its passage.
