AN ACT AUTHORIZING THE TOWN OF WEST BROOKFIELD TO CONTINUE THE EMPLOYMENT OF DANIEL SANTOS AS DEPUTY FIRE CHIEF
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding any general or special law to the contrary, Daniel Santos, deputy chief of the fire department of the town of West Brookfield, may continue to serve in such position until the date upon which he reaches the age of 70 or until the date of his retirement or non-reappointment, whichever occurs first; provided, however, that Daniel Santos is mentally and physically capable of performing the duties of such position; provided further, that the select board of the town of West Brookfield may, at the expense of the fire chief of the town of West Brookfield, require that Daniel Santos be examined by an impartial physician designated by the select board to determine such capability; and provided further, that no further deductions from the regular compensation of Daniel Santos shall be made under chapter 32 of the General Laws for any service performed subsequent to his reaching the age of 65. Upon retirement, Daniel Santos shall receive a superannuation retirement allowance equal to that to which he would have been entitled had he retired upon reaching the age of 65.
SECTION 2. This act shall take effect upon its passage.
