AN ACT FURTHER REGULATING THE SYSTEMS OF SEWERS IN THE TOWN OF DEERFIELD
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 3 of chapter 343 of the acts of 1935 is hereby amended by striking out the words “board of selectmen” and inserting in place thereof the following words:- select board.
SECTION 2. Said chapter 343 is hereby further amended by striking out sections 4 and 5 and inserting in place thereof the following 2 sections:-
Section 4. Any person injured in their property by any action of the select board under this act may recover damages from the town under chapter 79 of the General Laws.
Section 5. The town shall, by vote, determine what proportion of the cost of the system of sewerage and sewage disposal the town shall pay; provided, however, that the town shall not pay more than 25 per cent of such cost. In providing for the payment of the remaining portion of the cost of or for the use of the system, the town, through its select board members acting as sewer commissioners, may apply methods permitted by the General Laws and the provisions of said General Laws relative to the assessment, apportionment, division, reassessment, abatement and collection of sewer assessments, liens and interest, shall apply to assessments made under this act. The collector of taxes of said town shall certify the payment of such assessments or apportionments to the select board, which shall preserve a record of such certifications.
SECTION 3. Section 8 of said chapter 343 is hereby amended by striking out the words “board of selectmen” and inserting in place thereof the following words:- select board.
SECTION 4. Section 9 of said chapter 343 is hereby amended by striking out the words “board of selectmen” and inserting in place thereof the following words:- select board.
SECTION 5. The first sentence of section 10 of said chapter 343 is hereby amended by striking out the words “not exceeding twenty dollars” and inserting in place thereof the following words:- in accordance with the General Laws and any by-law adopted by the town.
SECTION 6. This act shall take effect upon its passage.
