AN ACT AUTHORIZING THE TOWN OF RUTLAND TO INCREASE THE MEMBERSHIP OF THE TOWN'S BOARD OF SELECTMEN

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Notwithstanding section 1 of chapter 41 of the General Laws or any other general or special law to the contrary, there shall be in the town of Rutland a 5-member select board, with each member to be elected for terms of 3 years so arranged that the term of at least 1 member shall expire each year. The select board shall have the powers and duties of a board of selectmen under any general or special law.

SECTION 2. Notwithstanding sections 21 or 69D of chapter 41 of the General Laws or any other general or special law to the contrary, there shall be in the town of Rutland a 5-member board of public works. The board of public works shall be comprised of the members of the select board and shall have all the powers and duties of a board of public works under any general or special law.

SECTION 3. Notwithstanding any general or special law to the contrary, all actions taken by the select board, board of public works and town meeting increasing the size of the select board and authorizing the select board to act as the board of public works are hereby ratified, validated and confirmed to the same extent as if this act had been in place prior thereto.

SECTION 4. Members of the select board serving as of the effective date of this act shall serve the remainder of their unexpired terms unless such members sooner vacate the office.

SECTION 5. This act shall take effect upon its passage.
