AN ACT AUTHORIZING THE TOWN OF CONWAY TO CONTINUE THE EMPLOYMENT OF FIRE DEPARTMENT MEMBER HOWARD BOYDEN
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding any general or special law to the contrary, Howard Boyden, a member of the Conway fire department, may continue to serve in such position until he reaches the age of 70, the date of his retirement or the date he is removed or suspended from office, whichever occurs first; provided, however, that Howard Boyden remains physically and mentally capable of performing the duties of the position; provided further, that Howard Boyden shall, at the expense of the town of Conway, be examined by an impartial physician designated by the town to determine such capability. No deductions shall be made from the regular compensation of Howard Boyden pursuant to chapter 32 of the General Laws for any service performed subsequent to his reaching the age of 65 in connection with his service to the town for retirement or pension purposes and, upon retirement, Howard Boyden shall receive a superannuation retirement allowance equal to that which he would have been entitled had he retired at 65 years of age.
SECTION 2. This act shall take effect upon its passage.
