AN ACT RELATIVE TO THE TOWN OF DENNIS BARRIER BEACH PROTECTION STABILIZATION FUND

     Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:
     SECTION 1.  Chapter 108 of the acts of 2011 is hereby amended by striking out section 1 and inserting in place thereof the following section:-
     Section 1.  Notwithstanding section 53 of chapter 44 of the General Laws or any other general or special law to the contrary, there shall be in the town of Dennis a special fund to be known as the Barrier Beach Protection Stabilization Fund.  There shall be deposited into the fund, without further appropriation, monies in the amount of 40 per cent of the fees collected by the town of Dennis from the sale of off road vehicle permits.  Appropriations from the fund shall be made by a two-thirds vote of a town meeting and shall be used exclusively for barrier beach protection, including permitting, law enforcement and restoration. The percentage amount of the off road vehicle permit fees to be deposited in the fund may from time to time be increased or decreased by a majority vote of a town meeting.
     SECTION 2.  This act shall take effect upon its passage.
