AN ACT RELATIVE TO SEWER COMMISSIONERS IN THE TOWN OF WAREHAM

     Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:
     SECTION 1.  Chapter 258 of the acts of 1938 is hereby repealed.
     SECTION 1A.  Subsection (b) of section 3-7 of the charter of the town of Wareham, as appearing in section 1 of chapter 114 of the acts of 2014, is hereby amended by adding the following 2 sentences:-  Except as expressly provided by this charter, the board of sewer commissioners’ authority and the sewer superintendent’s responsibilities shall pertain only to the technical operation of the sewer system and facilities. The town administrator shall maintain and exercise administrative control over personnel as provided by this charter and the board of selectmen shall be the town of Wareham’s sole collective bargaining agent as provided for by chapter 150E of the General Laws.
     SECTION 2.  Subsection (d) of said section 3-7 of said charter, as so appearing, is hereby amended by striking out paragraph (1) and inserting in place thereof the following paragraph:-
     (1)  The sewer superintendent shall be responsible for the efficient technical administration of the sewer system and facilities and for implementing votes of the board of sewer commissioners that are within the commission’s jurisdiction.  Except as expressly provided in this charter, the board of sewer commissioners shall not have control over personnel matters.
     SECTION 3.  Paragraph (2) of said subsection (d) of said section 3-7 of said charter, as so appearing, is hereby amended by striking out, in lines 1 and 7, the words “sewer superintendent” and inserting in place thereof, in each instance, the following words:- town administrator.
     SECTION 4.  Said section 3-7 of said charter, as so appearing, is hereby further amended by adding the following 2 subsections:-
     (e)  The board of sewer commissioners shall provide a detailed and balanced budget for the sewer system and the Sewer Enterprise Fund to the town administrator by January 5.
     (f)  The removal of the sewer superintendent shall be governed by section 7-9.
     SECTION 5.  Section 1 shall take effect as of May 22, 2014.
     SECTION 6.  Sections 1A to 4, inclusive, shall take effect upon their passage.
