AN ACT AUTHORIZING THE TOWN OF DEDHAM TO GRANT AN ADDITIONAL LICENSE FOR THE SALE OF ALL ALCOHOLIC BEVERAGES TO BE DRUNK ON THE PREMISES

      Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:
      SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws or any other general or special law to the contrary, the licensing authority of the town of Dedham may grant 1 additional license for the sale of all alcoholic beverages to be drunk on the premises pursuant to section 12 of said chapter 138.  The license shall be subject to all of said chapter 138 except said section 17. The licensing authority shall restrict the license granted pursuant to this act to an entity located in the Mother Brook Arts and Community Center building located at 123 High street in the town of Dedham.
      (b)  Once issued, the licensing authority shall not approve the transfer of the license authorized in this act to any other location, person, corporation or organization.
      (c)  Notwithstanding section 12 of chapter 138 of the General Laws, the licensing authority may restrict the license issued pursuant to this act to holders of common victualler licenses.
      (d)  The license authorized by this act shall be subject to an original application fee of $5,000 more than the annual fee for existing alcoholic beverages licenses in the town of Dedham.  The additional $5,000 fee shall be deposited into an economic development account in the town of Dedham and expended consistently with the purposes of the account.
      (e)  If a license granted pursuant to this act is revoked or no longer in use, it sha ll be returned physically, with all the legal rights, privileges and restrictions pertaining thereto, to the licensing authority and the licensing authority may then grant the license to a new applicant at the same location under the same conditions as specified in this act.
      SECTION 2.  This act shall take effect upon its passage.
